Welcome to the new look VWWatercooled

After much work and little sleep there is a new version of the forums running on more powerful and recent hardware as well as an upgraded software platform.

Things are mostly the same, but some things are a little different. We will be learning together, so please post questions (and answers if you've worked things out) in the help thread.

The new forum software is an upgraded version of what came before, it's mostly the same but also a little different. Hopefully easier to use and more stable than before. We are learning together here, so please be patient. If you have questions, please post them here. If you have worked something out and can provide an answer,

    I am concerned about the fuel economy, and I have no doubt that they will publish figures showing that fuel economy is unchanged.

    This will be under laboratory test conditions, which is when the existing published economy figures were determined - while they were also meeting emissions standards. Now they will still meet emissions standards, and obtain the same fuel economy - under the same laboratory test conditions that were used previously, meeting the same emissions standards they met previously.

    What will happen to fuel economy outside the laboratory, when the vehicles now operate to the emissions standards to which they should've been operating, but weren't?

      • I found this interesting from the Maurice Blackburn Volkswagen Class Action Frequently Asked Questions:

        Am I obliged to sign the Retainer in order to be in the class action?

        No. The class action is being conducted on an 'opt-out' basis, and therefore any person who acquired an interest in an affected vehicle and has suffered loss due to the alleged conduct, will be a group member in the class action. Therefore you do not need to retain us as your lawyers to be a group member. However, only those people who retain us will receive regular updates, have steps taken by us to assess their individual claim and receive individual advice from us.
        Essentially, this seems to say that anyone who has an affected car is part of the class action unless they specifically opt-out, but you will have to argue and prove your own individual claim amount if you do not retain them. Anyone care to comment?

            There's a big difference, Bosch wrote the software knowing that the vehicles would be driven on the road and despite having informed Volkswagen that this would be illegal, continued to provide the software. They were aware that the product was going to be used for an illegal purpose, in fact, the sole purpose of the software was that it be used for an illegal purpose. On the other hand, Apple, sell phones in good faith expecting them to be used for legal purposes, that someone uses them for an illegal purpose is beyond Apple's control and not the sole purpose of the product.

              • Bosch provided software with the ability to disable/enable functions for testing purposes. Just as the Motronic fuel & ignition module allows the engine tuner to alter those parameters based on MAF, throttle & O2 sensors. The final implementation by the engine tuners is not Bosch's responsibility

                    As I understand it, (and I may well be wrong) the software was written to detect when the vehicle was being tested and switch the engine to a "test" mode with lower emissions only to revert to normal operating mode and emissions when the software detected that the vehicle was no longer being tested. In that case, Bosch must surely be viewed as a co-conspirator.

                    I agree with Hillbilly though, it's all supposition and we all have to wait and see.

                      The email, uncovered by the advocacy group Corporate Europe Observatory, proved a Volkswagen senior executive writing to the European Commission (the EU’s executive body) saying that: “Such topics must be deleted.”

                      Though the executive’s name has been edited out, it runs counter to the Volkswagen Group’s new-found commitment to ethics, transparency and accountability. Volkswagen has refused to name the executive responsible for the email, though sources at Volkswagen confirmed its veracity.

                      “We cannot agree to a regulation including undefined topics like cold start or high speed,” the email stated.

                      Why VAG, WHY ???

                        I don't see anything wrong with what VW did in this circumstance. In all policy development, parties lobby and negotiate in their own best interests. This is no different to the food industry lobbying over health labelling, the hotel industry lobbying over lockout timings or unions lobbying over stop work provisions. In the end, all policy is a compromise to balance the positions of stakeholders, while hopefully still meeting regulatory aims.

                            Bosch's legal position in this saga will surely be tested in the courts and by regulators. They will have to explain why if they knew their software could be used for illegal purposes in production vehicles, they continued to supply Volkswagen with the engine management system containing this software. Isn't this collusion? It seems Bosch's culture is the same as Volkswagen's, where profit and market share rule above all other considerations. Their practices must change to restore market confidence in their names.

                              VW were not breaking any rules (well not this time), this was a discussion about what would and would not be included in forthcoming legislation. All businesses have the right to have input into what should or should not be included in legislation.

                              As for the wording of the report by Carpoint.com, it's sensationalism at it's worst, typical of journalism today.

                                There's only one question Bosch needs to answer, in my opinion.

                                "What was the intent behind writing of the code identified as the "defeat device"?
