I know personally, on my contract if they don't deliver within 45 days of the delivery date stipulated on the contract, i'm entitled to a full refund no questions asked.

Standard terms and conditions on a Contract to Purchase a Motor Vehicle

4.1 The Dealer will deliver the Vehcile to the Purchaser on or before the Delivery Date stated in this Contract.
4.2 In the case of a new vehicle, if a Delivery Date is not stated on this Contract, the Dealer will deliver the vehicle within three (3) months of this Contract becoming binding on the parties.

7.1 The Purchaser may terminate this Contract if the Dealer has breached any of the obligations imposed on the Dealer by this Contract.
7.2 If this contract is validly terminated by the Purchaser, the Dealer must immediately refund any deposit paid and return any Trade-In Vehicle to the Purchaser. If, in the event the Trade-in Vehicle has been sold, the cash equivalent of the Trade-In Vehicle value determined at the commencement of the Contract shall be refunded to the Purchaser.

Though I would get advice before considering validly terminating the contract.

Yeah - I would imagine if there is any out clause on sharkablue's contract, it'd be something like this rather than the "3 months delivery" that Maltopia has mentioned are from the standard motor vehicle contract conditions.... obviously almost no European manufacturer would be able to deliver within 3 months if a factory order was required.

Which is fine, except for the fact I know the car has been in Melbourne for over 3 weeks now. It will be interesting to see. Because I have a mate who's Tiguan arrived 1 week ago in Melbourne for the same dealer.

So I will be keen to see who gets the call to collect the car 1st.

Yeah and as I've said numerous times before, the issue isn't that it's been in the country for 3 weeks, because that's not at all exccessive, the issue is your dealer won't call you back... continually saying 3 weeks is irrelevant - many people have had their car in the country for much longer prior to it being delivered - and the majority of the time the delay has nothing to do with the dealers....

Hi coreying, in the case of a factory order, the dealer should then fill out the delivery date box on the contract and estimate long to give them more than the 3 months and cover them for reasonable delays, ie section 4.1 of the contract would be used by a cluey dealer.

Just as an update for my own personal cirumstances, my car arrived in Melbourne last week on the 30th of June. Today it arrived in Sydney (Rose Hill) where it's at a holding yard (Ran by AutoNexus). I know this as a friend of mine works there and sees every VW and Subaru that comes through, and I gave him my VIN. He told me today that the car should be able to be in my hands in approximately one week, if I hassle my dealer to get a move on.

Yep - mine is on the Morning Glory, should be collecting from the dealer early next month (a month premature)

Does anyone know what it means on the VIN Number tracking website with the following:

Discharged: 14/06
Delivered From: 17/06

What is the difference? Does Delivered mean it was delivered to the dealer? and Discharged is when it was put onto the docks?
