VW then have to prove that the ECU failure was due to the tune - based on the massive amount of ECU tunes out there, that could be an uphill battle for them ?

Of course, but that would take a time. I remember that failed car was from QLD and he was waiting I think at least 1 month for his car to be fixed. Sure many things can go wrong with the car, but many just happen in the first 2,000km. There are a fair few VW dealers who are also tune dealers in the USA. Strange we dont have any/many here.
