      I wrote off a brand new s2000 in 2001. Insurance was swann and they basically wrote and sent a chq for what a new one cost so I went back to the same dealership and gave the same salesman the chq and said I want another one. He was happy to sell 2 s2000 in the span of a few months

          That's true, when they first came out it was about 6 mths.
          My point was, they cut a chq for the amount I bought the car for. Hopefully they just give a chq then u can go shopping

            That will be your problem I think. If they can't replace it exactly (except colour) and swiftly then they will write a cheque for the agreed value.

                        It's just a pity that Gambit's car wasn't written off closer to the end of the 2 year period

                          People have to be careful with that clause. It's only new for old if the car can be replaced with essentially the same model/options etc.
                          If it can't (and in a reasonable time period)... you get written a cheque.

                          If you had a Polo GTI with leather trim/xenons... then the replacement car has to be similarly optioned.
