I just got a email from George from Burger motorsports regarding the $75 refund, I asked him if I would still qualify if i had purchased from autoinstruct.

I should now finish my post (D'Oh)
... my car was serviced at the end of November. The dealer said nothing about a tune box. I specifically asked if everything is OK and where there any issues. The response was "no, totally normal first service. Everything is fine. We did your Nav map update and rotated the wheels as discussed. Your handbrake is operating normally."
So either they couldn't tell or they weren't letting on.
