i got rear ended by a young girl years ago in my mx-5 all tears and sorrys her father rings up and wants to keep it out of the insurance system but then asked for me to get 3 quotes. Sorry champ your dealing with the insurance company now. I figure bugger anyone in the wrong

she has already admitted to the police she didn't give way, and today after i gave my statement of the event he told me she would be charged with failing to give way

It's a harsh lesson, Ian, but she has to be taught that there are consequences to her carelessness. You don't need to feel sorry for her at all, you could have been seriously incapacitated or worse. I'm not a heartless b*stard, I just see far too many close calls and downright poor behaviour on the roads. I've learnt to drive defensively expecting the worse, no doubt you'll be a LOT more cautious on the roads from now.

saw your photo's. My Gt was less damaged than that and also less costly.
I had to push the issue and glad I did. Get you Radiator support pannel checked.
Its made of a plastic and has a big effect to the integrity of your car in an accident.
Mine was replaced (as I said, I pushed the issue). Initial ispection Radiator pannel
was OK, even on removal but when the Boss of the repair shop inspected it further
There were hairline fractures. This could be the difference of survival or not in another
accident.

Also CRAZY Roundabout laws.
Hope your rite and got a witnesses, It can be a mine field.
I was walking near home, just after a Roundabout. A car going too fast and with lack
of caution, hit my foot. I was more than 1/2 way across the roundabout before she
even entered onto the roundabout. To my suprise, I checked the legislation and the
Police were rite. Motorist on a roundabout are not required to give way. In fact
technically a motorist can be booked for obstucting the flow of traffic, when giving
way at a round about. (The other laws she probly broke, did not interest the Police).
But this shows how dangerous the roads are and with idiots making crazy laws. So
If you ever kill a pedestrian, you better hope its on a roundabout.

From my experience I would never bend the truth or fail to inform the police about anything as it may bite you back in the future - you may be under the impression its obvious that its her fault and that everyone can see it but....- my wife was rear ended once - clear cut case and bloody obvious who was a fault - minimal damage so we elected to just pull over to the side of the road, no police, exchanged details and later made a claim. Turned out he blamed my wife ( claimed some crap about her cutting him off and slamming on her backs causing an impact ) and we had to go through about a years worth of arguments with the insurance company and involved the ombudsmen to try and prove she was not a fault. Eventually it all worked out but I wasted so much time proving it - next time regardless of the accident I'm calling the police and ambulance straight away and let them document every detail.

With regards to the girl that hit you I would especially let the police know about her mobile phone use because people like that need to be taught a lesson and taken off the road as soon a possible. She was lucky in this situation that no one got hurt but what if it happens next time with say someone on a motorcycle???

Easy to get the police attend. They must attend, by law if someone is injured.
All it takes is a scratched finger or a knock to the head. Any injury no matter
how small should be reported and also checked by a Doctor.

For a repairer in Kingswood, I can't recommend Merv Shipp smash repairs highly enough. I have had a couple of dealings with him.

I didn't want to make a big deal of her using her mobile, not just because she was a P plater,firstly she was insured with Alliance and i didn't want to put any road blocks in the way of claiming against her insurance, and i had 2 other witnesses in the car and plenty of Pics and she readily admitted she was at fault, Also i got a hire car through Compass claims which she also has to pay for through her insurance.
I know people will say i'm being soft on her but i think she has learned a expensable lesson ,she could be out of pocket over $2,000

Thanks but the car is already there and there an approved NRMA and GIO repairer.

I doubt that her excess would be that. Most likely $300 - $400, probably her monthly phone bill. Lesson quickly forgot most likely.

Well i have a maximum discount of 60% guaranteed for life and i'd pay $400 and if i have a person under 30 drive my vehicle there a $1400 excess and thats not a P plater . Just what are P platers excess on their insurance policy's ?

Wow, yeah I guess its been a while since I was a P plater. I remember having a turbo car when I was a teen and paying a lot for the yearly premium but the excess was always under $500.
