It's not really a grey area. It's not legal for them to "void your warranty", and there are legal avenues that you can take if some bodgy dealer attempts to give you the shaft.
You're allowed, by law, to change anything that you'd like (within the ADRs etc) and maintain your warranty. Just like you can have whoever perform the log book servicing on your car, and you will maintain your warranty. What manufacturers are not required to warrant is the parts that you have changed, or any problems caused by them. But they have to show that the part you changed caused the problem.
So if you changed something on your car, say the ECU, and your power window motor fails, since the ECU has nothing to do with the power window motor, you window should be repaired under warranty. If you changed the ECU and you had a broken crank shaft - then you may have an issue on your hands.... but I've never heard anyone who has had their ECU flashed by one of the vendors of this site who has then gone on to have a warranty issue due to the ECU flash.

Worst case scenario, it will only affect the warranty relevant to the area that's modified.
i.e. engine makes 30% more power, therefore the gearbox broke, dealer rejects warranty claim.
I believe they should have to prove that the failure was due to the additional power, and not a manufacturing fault.
in reality, it may be up to the owner to prove that it didn't.
If you modify the engine and a door falls off, it will still be covered by warranty.

And yes I agree that If your window motor goes, an ECU change should not effect it. But thats not the issue. The window motor is not that expensive to fix.
If though, your DSG goes, or the Motor goes, and you have had engine mods done, you can kiss your warranty goodbye, from most dealers.

You'd be surprised REXman. The only engine failures I've ever seen are the 118TSI ones. This was a VW issue and they were replaced regardless of whether the ECU had been flashed or not.
In all the "DSG failures", the large majority is the mechatronics module and not the "gearbox" itself. This too has been replaced underwarranty regardless off other hardware modifications present. As Mr_Bob mentioned, sometimes it can end up being up to the customer to prove that their changes aren't affecting the problem, and so if you're having stuttering or something from the gearbox, putting it back to stock (or within reason) may assist in that diagnosis, but then that type of thing extends into other industries too (computer industry for example).
(I obviously don't have statistics to prove the every single case has been covered within warranty, but if you look around here and other sites on the internet enough, you can see that there has been lots of documented cases where common sense has been used in determining warranty issues).
