The receivers and the banks get paid first. Investors and unsecured creditors get the last leftover (if any) unfortunately....

So who do you hold accountable?

Volkswagen Group Australia? The dealership, or what's left of it? The administrators?

All of the above really, but there's not much I can do. I have to hope VWA actually try to provide good customer service, because there is little to no recourse for me.

Honestly, chances are the car has already been invoiced and on the books with Bryan Byrt, therefore would most likely fall under the control of the administrators.

I think the best you can hope for is that VGA can find you a similar one, and discount it accordingly.

Unfortunately, when dealerships go under, they take a lot of people down with them. Not just staff, but suppliers and customers too.

I'm in much the same boat as GTR27, except I bought a golf through Bryan Byrt VW at Capalaba. Was due to take possession this week, having been notified the car docked sooner than expected just to have BB go into receivership. Have called VW Australia six times this week and was told someone would call me back each time and they haven't thus far. Unable to contact anyone at Deloitte (the receivers). As soon as receptionist hears you say Bryan Byrt she puts you through to someone's message bank. No idea what's happening with my golf at the moment and getting a bit over it. Hopefully there will be good news at the end for people like GTR27 and I.

The guy the sits next to me at work got his Tiguan from BB 3 weeks before they closed their doors. Tried to get him to test the Yeti but his boyfriend likes brand names, no taste . They paid extra for an extended 3rd party warranty.
Because he has OCD about most things when he heard the news he called the 3rd party just to check it would not affect his extension. They then informed him that his extended warranty had been cancelled inside the 14 day cooling off period and the money refunded to BB. Needless to say he was livid with a capital L. He has since spoken to the Deloittes and gone of the long list of those wanting their money back. If anyone else bought their car close to these dates it might pay to check your extended warranty is still active.

                      Bryan Byrt Warranty Issue

                      Hi all,
It has come to my attention in the last 2-3 weeks that Bryan Byrt has entered into receivership. I don't know how I didn't know about this for about a month as I live quite close to the former dealership at Capalaba but did not notice the cars gone. I have a large concern in that I purchased my Golf VII from there back around Aprili/May last year. The only extra I paid for was a Bryan Brt Extended Warranty. Set me back about $1,600 I believe. I have been in contact with VWA, who referred me on to Deloitte Touche Tohmatsu as the people to speak to. After receiving a call back from the appropriate person in the company, they have basically told me this warranty is worth squat and I have no way to recover this or enforce a new warranty through anyone. They suggested I go to the liqduidator, BDO, and see what they say however they also said they would only say the same thing as has already been said.

Has anyone been/is anyone in this situation? Are there any possibilities of either a) having some kind of extended warranty still be valid, or b) get my money back? All of your comments are very much appreciated!

                      Thanks in advance.

At best you will be an unsecured creditor so get your sleeping bag and get in line behind all the rest.

From what I have been hearing you are basically stuck with no extended dealer warranty and no way to recover the money.
The usual liquidator/receiver/administrator actions will be followed and the customer is almost always last on the list of people to receive a refund for goods not delivered.

As its a golf7 are you sure it was a BB warranty and not a extended vw allianz (cant spell)(as in the insurance company) warranty?? For that price it looks like the vw one especially on a new car. BB warranty was usually for used out of warranty cars not new ones. Allianz warranty is usually 2 years after the basic 3 vw years warranty....

What does your paperwork say regarding the underwriter of the policy?

I agree with VWMOTORWORX, usually those extended warranties are sold with used cars as an extra profit boost. For new cars they throw them in providing you get all the servicing done at the selling dealership (usually at shorter intervals).

If you haven't any paperwork then they've done you over right from the start.

You are right about the intervaled servicing, I recall the saleperson stating that when I signed for it. It is definitely a BB warranty, officially titled a 'Byran Byrt Vehicle Warranty-Gold Plus', which is valid for three years after the manufacturer's warranty expires (So extended from 2017 to 2020 for me).

I have a warranty number for the policy, but obiviously that does not help me if no one will even listen to me. Cost $1,595, I admit I probably got done harshly there a little. At the time the guy explained to me that the VW one was a fair amount more expensive and only lasted 2 years. I was satisfied with this as I was aiming to spend a bare minimum to last me for a considerable time (90TSI Manual driveaway, floor mats and the warranty being the only extras [and the floor mats being free ]). So you can imagine my frustration in having spent a fair emount extra on top of the car's value to find out it is now useless. I am now a full-time student and paid the car off from my full time work last year, and was hoping that I could have peace of mind throughout my studies over the next few years.
