  • Been ripped off...

    hey everyone,

    just a quick one, I purchased a car through a queensland wholesaler at the end of august last year, the car had a few months of NSW rego remaining, the dealer advised me to drive it until it lapsed as it would be wasted if I did not, I did not think anything of this so did exactly that. I also got the car serviced and bought some coilovers, wheels and tyres, personalised plates and other things for it. All up I would have spent around $6000 on it in this time.

    When I went to register it, I was told that the car had been written off in NSW and that I would need to get it inspected at a large cost to myself, now going by some other threads I have read, It looks to me like the car was misrepresented. I have spoken to queensland dept of fair trading and they confirmed this.

    how should I proceed with this matter? I am going to go down there this morning and let them know but I am unsure of how much I should say re: talking to qld dept of fair trading and the fact that I will take them to court over this if it comes to it. I do not want to threaten things as this never seems to work unless I try to be calm first.....

    Maybe just say iv had a few problems regarding rego transfre.

    Act a little dumb and see their response. Then if things dont work out hit the big guns...

      Car dealers are suppossed to do a nationwide REVS check on all secondhand cars.

      Thus, they should be aware of the cars history and so ignorance is not an excuse.

      You should go in and speak to the sales manager and explain that the car has been misrepresented and that you are within your rights to goto court and fair trading.

      Suitable outcomes might be for them to pay for the QLD inspection and you keep the car.

      Or for them to buy the car back from you at a price you both agree on.

      In reality a repaired write off is no big deal, it doesnt take much to write off a Golf 3 these days, but the written off identifier makes it harder to sell.

      If it was a private sale, it is 100% buyer beware (caveat emptor) and you would have no rights at all.

      In NSW car dealers have to give no warranty on cars under 10k but I believe they are meant by law to make you aware of the written off status.

      I dont know the law in QLD, but you could find out pretty easy.

      Good Luck with it.

      P.S if you were to drive it to NSW and just get an easy pink slip, you could reregister it without a difficult identity check inspection

        In the first place...why was it written off? eg. all flooded cars should have a tag stating that it was...

        Find out if can wat actions this car was bought at from that yard, this could be a big plus in helping to solve the issue with some inspection report...

          Just spoke to revs, turns out its a repairable write off. Does that make any difference?

              Just put it in the hands of the Dept. Fair Trading. Get them to sort out the dealer who shouldn't be allowed to sell a repairable write off unless the car has past all the required inspections and paperwork is signed off.

                  100% they have to tell u.....i worked in a second hand yard and by law they must.....

                    They are being ****s about it, saying all they will do is get it registered for me. I don't want that though, I want compensation! The fact that it has been written off makes it less valuable. I would not have bought the car if I had known this before as it was always my intention to sell it a year or so later

                        sure does mate.

                        the price you paid for that mk1 was ridiculously cheap so get the hell over it. i never lifted the carpets so how the **** would i know what rust it had?

                          Wouldnt have any idea what that attack is about euro but if its what I think then Billy must have had similar issue to what you have?
                          Either way, it pays to have a car and paperwork checked thoroughly before buying...

                              The fact they've agreed to get it registered is AWESOME! Because they'll have to get all the paperwork that goes along with a repairable write off. Just make sure you get ALL the paperwork. Contact your states RTA just to find out every sign off you'll need.
