Patent Question

Hey guys and gals, i know there a very clever people one here, those in the know and those how know those etc, if someone were to come up with a grand idea what is the go with patents??????? do you visit a lawyer/Barrister and show them the idea or is there a governing body you contact?????

Jimmy -- you'll probably need a patent attorney...it can be a long and tortuous process. A good starting point is the IP Australia website

Just make sure your idea is novel and isn't obvious to someone skilled in the art. Also it must be tangible or be able to be physically demonstrated.

From what I can gather (having no direct experience) the hard bit is not having the original idea, it is how to make money out of it (manufacturing, distribution and marketing).

Maybe contact the ABC TV show the inventors and ask them if they know someone who can give you good advice (you will probably have to pay for it if they are any good though).

Is it anything to do with locking nuts on turbos by any chance ? Maybe you can get VW or turbo manufacturers interested - just watch out, people have been burnt badly dealing with big manufacturers who take their idea and adapt it enough so it is no longer covered by the original IP.

Do not discuss the idea with anyone other than a patent attorney...

Also even if the idea is borderline obvious to someone skilled in the art, if it becomes a product you can patent the design, not necessarily the theory.

Not lock nuts mate HEAPS better. They will be ready in a couple of days

Like others have said the IP Australia site and find a Patent Attorney. At this stage don't worry about things like manufacture, distribution, etc the thing is to tie up the design/idea then worry about stuff like that. Keep the discussions with others to the very minimum until you get paperwork processing.

I used to work in R&D as a Chemist for a large multi-national and we would patent - or at least try to - everything we could so that opposition companies would be limited in copying or competing with us. Keep notes, etc of what you have, especially with dates, etc for the idea/design you have, things like that become important to show you had the idea/design first if someone tries to appeal/block your patent application.
