Mate as bad as it sounds - these things just happen sometimes.

The best thing you can do is keep on their back and make it clear in writing that you expect some form of compensation for your troubles.

That is ontop of them providing you another service vehicle / demo car (whatever) to use for all days that the car is experiencing this issue.

If they dont come to the party at that level, get a solicitor involved or local ombudsmen etc.

ps. You will not get a refund or permanent replacement vehicle and should not expect as such either.

Mate, I think everyone here would feel for the situation you are in, but in all honesty your car has a lot of components and sometimes a car slips through with an issue.

I think the best way to manage the situation is with a bit of firmness and diplomacy - threats and heavy handed tactics are not going to get you anywhere. Maybe speak to VW Australia, definitely you should get a loan car.

As far as the law goes, they are doing all that is required of them which is to resolve your issues as soon as they can. ACCC, fair trade whoever are not going to back you for a replacement car or refund over this - sorry to break that news.

I am sure it will be fixed soon enough.

Unfortunatly "Lemon's" do happen from time to time.

The good thing is that they are fixing it up for you. I (think) in Victoria, they also have a "lemon" law. I don't know how many other Australian states have this though.

This was a bit of info I was able to dig up:
Victoria first to adopt ‘Lemon Laws’ | Car Advice | Reviews
          My car: MY18 Arteon
My car #2: MY22 Volvo XC40 Pure Electric
Her car: MY22 Skoda Octavia Limited Edition Wagon

That is so, but it's hardly a lemon with a single fault? Otherwise every new car I have owned is a lemon!

I recall my MK4 GTI gearbox failed with only 150kms traveled. The dealer returned the car I traded as the replacement until the GTI was repaired lol, it was a strange experience driving my old car having just bought a new car, anyhow the car ran perfect for the remaining 3 years I owned it.

What sort of compensation should I ask for?

Don't think they will extend my warranty to 6yrs.

Once the new car's major parts being teared down and put it back, would that causing small issues in the future???

From memory the replacement gearbox took only 3 working days to fit & test etc.

trying not to sound like a broken record... but the above is all as correct as can be

i would assume they would give you a loan car to the equivelant until it is repaired (its only fair, especially considering you havent owned the car for more than 24hrs!!)... my pog was 2 days old and developed a knock, parts were going to take 3 days to get to the dealer, they gave me the keys to a new polo tsi for the time it was in the shop, and my pog was a 2nd hand purchase

You will not get (nor are entitled) to anything for free like extended warranties etc so get that out of your head mate.

Get a loan car - insist on it. Enjoy the car when it's ready.

Only Advice I can give is be firm but accommodating. Faults happen. They will do all they can to fix it and the last thing you want is to be put on some sort of blacklist for being a difficult customer.

Thanks for all advice mates! that really helps

I asked for a loan car, they gave a 2.0 TDI DSG.

20th/Dec/2010 12:40pm A Call from Dealer, Could be throttle sensor wire fault, ordered a parts from Sydney, Parts ETA tomorrow morning and fit-in afternoon

Will try my best see if I can get any compensate and let you guys know.

Does anyone know about placing throttle parts? Do they have tear down the whole engine or just something from interior?

Would hate to have lose parts noise after all....
