    I am awaiting a new car for delivery as well and thought I would chime in. My understanding is that you can only walk away from a contract if the breach is major, not for just any breach. You can specify what you believe a major breach is, but generally it would not be something like the omission of fog lights. In such a case the dealer is probably only obliged to refund the cost of the option. That is, in many cases it would be argued that the value of the breach (probably under $500) was not significant given the size of the transaction (maybe $30k+). It could probably be argued that the difference between manual and auto was significant.
    At present many of us are waiting for popular cars so the dealer probably won't lose out if you cancel, but if something is crucial, or the timing is important, i would specify what was a major breach.

      I understand that is the case, that FACTORY foglights are only available now as part of the sports pack. We have just the foglights on our MY10 118TSI, going for comfort more than sport. I do remember, however, that foglights could be a dealer fitted option. This may or may not be the case now, but I can't see them changing the entire wiring loom.

      Presuming they haven't it should just be a matter of screwing the lights in, plugging in the wires and enabling them in the body control computer.

        Further to my previous post above, about ETKA, I was advised to check out erWin (VW's Electronic Repair and Workshop Information service), to get a comprehensive list of the specs and options fitted to my car. I paid my 5 euros for an hour-long subscription and, based on my VIN, grabbed all my car's relevant details. erWin is a handy resource if you want to check your car's spec pre-delivery and don't mind paying a little.

        Anyway, it turns out that the information I was seeing in ETKA corresponds exactly with what erWin reported. So, in my experience, both of these tools are very useful for checking the spec of your car once you have your VIN.

          So what do I do in this situation???

          Hi all,

          I am pretty new to this forum , I am hoping for some advice because I am at a loss.

          I purchased a vw 6 long months ago, for $X happy with price . Today was my happy day got the call to pick it up. When I was presented the keys and shown the car it was not what I ordered.

          My problem is the invoice i signed on order is what was delivered. When i ordered the car 3 months ago and signed and I questioned dealer about what was on invoice he said no problem the car is on order just an oversight on invoice it's all ok. So my fault for signing i guess.

          So I did not take car they are not making me take it(dealer knows he was in wrong but has my signed document which is what they are leveraging) Dealer now telling me car I wanted is going to cost extra $$$ and I may have to wait 3-4 months. I am now sleeping on it

          What rights do I have??? what should i do???

            G'day D/show,

            Sorry to hear that after you have waited so long. A few questions;

            What is the disparity between purchase (6months) and ordering (3 months)? Or was this a typo.
            Did the dealer pressure you to sign the order?
            What was difference between the car you ordered and what they delivered?

            Contract law pretty much says you have a binding agreement, but the dealer has acknowledged that there has been an error. I would suggest shopping around for some quotes from different dealers (even interstate) prior to commiting if the car in no way reflects the car you ordered. This will have an effect of disolving the contract and entering into a new contract, hence conditions are to be negotiated.

                thanks for reply to answer your questions yes it was a typo ordered it 3-4 months ago
                I did not feel pressured as I negotiated a price for the car I wanted so i was happy to sign, I spoke at length to dealer about what I wanted
                difference in car is I ordered a wagon and got a sedan again spoke at length with dealer about my need for wagon at time of sale

                the fact that they are looking into it to try get the car i ordered is to me admisson they knew they messed up and from the body language of the dealer he knows and remembers the fact I wanted a wagon although he is playing "i don't remember our conversation it was 4 month ago " card.

                I will wait to see what solution they come up with but i am not waiting another 4 months for the car in the spec I want . I may just cut my losses and get something japanese for the same price with more included goodies, but i so wanted to join the vw family, but the whole thing has left a bad taste in my mouth

                  I picked up my car on Monday and i didn't get the reverse camera that i ordered. The dealer gave me 3 options either wait another 6 months, dealer install it but at a higher price and it also wouldn't be fitted into the badge or just forget about it and get my 500 refunded back to me.

                  I went for the 3rd option as it was only the reverse camera and i only got it because i thought $500 for the camera so what the hell.

                    Was the RVC on the contract?
                    If so, and it was their fault they forgot to put it on the order, then I would have pressed them to install it, in the proper location, and absorb the cost themselves...

                      My dealer told me I could only get the reverse camera if I was also getting the satnav. I told him I didn't think that was right - that the brochure suggests the satnav is only required for the park assist but he insisted. I'm still not sure what the actual truth is, but like you I was only getting it because $500 sounded cheap and I thought I might as well.
                      The only reason I mention it is because your sig doesn't mention the satnav either... and maybe this indicates a more widespread confusion on the matter
                      Does anyone actually have the reverse camera but no satnav?

                        The RVC needs a color display screen that can handle video. That is the RNS-510 or RNS-310.

                          NEVER EVER sign the contract until you are satisfied that it states exactly what you have ordered. Never trust a salesperson - they are NEVER to be trusted. There is no legal recourse if you sign on a contract that doesn't state correctly the item/s you have ordered.

                            For Australia, the standard headunit for the GTI/GTD/R models is the RCD-510, which is a colour display screen.

                            This means that the RVC option for $500 is applicable to the GTI/GTD/R without having to option the RNS-510 (Sat Nav) head unit. As far as I'm aware, the RNS-310 is not available in Australia.

                              I can understand your anger and dissapointment. Reminds me of the Chevy Chase movie Vacation "You didnt order the metallic pea super sports wagon with optional rally pack!" Seriously though this is a major stuff up on their part. Have you posed the question as to them sourcing a similar vehicle (wagon) which may already be made/in Australia? They can search VW Australia stock control system for a match. It is in their best interests to keep you business. Otherwise it may be worth a call to VW Australia. Bad, bad experience.

                                RCD 510 doesn't have a video input on it unless you order factor RVC. So retrofitting it with a RCD 510 will require you to buy a video capable RCD 510 at around $2000 and the camera on top which at Australian prices will be a little over $1000.

                                RNS 310 is the sat nav option for the Polo, RNS 510 is only for the big boys cars of the Golf and above.
