I agree Jimmy. Definitely sounds like a diff failure. It is very disappointing that this is still happening to the new gearboxes too. I think it is well worth a try to get a warranty claim. Even if they agree to a proportion of the cost. I would be getting in contact with the Dept. of Fair Trade I think it is. Even though it is out of warranty goods have to be of a marketable quality. If you can show that the car has been adequately serviced and the cause it not due to misuse then I think you would have a valid claim to get VW to pay most of the cost.

The problem here is that its not known if its been adequately serviced. Gearbox oil is hardly ever checked from new so it could have been low from day 1, then its meant to be lifetime so no-one even bothers to check it!

In any case, 2007 isn't that long ago... sounds like a defective box, simple as that... regardless whether it was low in oil or not.

Cant agree enough mate. Lifetime, is lifetime of the warranty 3 yrs max. Great when you buy the car the salesman says get in it drive it and should never need to touch it, hmm what about the poor second buyer, doesnt make my life easy telling you that itll be mega bucks to fix. Autos, DSG and CVT a classic example. Keep them serviced folks, for emissions and seamless gearchanges there is a penalty at the end, scorched clutches and burnt oil, has to be. To change seamless in an auto the clutches have to cop it, have to. Most of the cars running around town at 40kms/hr are already in top gear crawling along. Great short term. this topic could be talked about for ever and a day, it already does at IAME meetings, journals and around the traps.

How do u prove it hasnt been miss used? Sure it might have been serviced but that doesnt mean the owner wasnt doing regular 7k clutch dumps. I'm not saying your cousin was but it really is a good faith system and entirely up to VW on wether they wish to replace it for free, from a legal perspective there is little to support you unless its under warranty, or if its a complete lemon or unsafe.

IMO anything second hand and i would be changing all relevant oil's at intervals if i were to keep the vehicle for an extended amount of time. But like you said JMAC hard to tell 2nd owner these items need servicing when in fact there filled for life?? I agree we could be talking till the cow's come home regading usage and all other types of driving styles and why the should or shouldn't be serviced...
