    Hi all,

    Am after any advice regarding my situation and please excuse my lack of car knowledge though after searching through all the posted threads I couldn't find any that are too similar.

    My 07 comfortline has a leak in the radiator which is requiring replacement. Firstly is this a common issue or one that anyone else has encountered? I am the second owner though the car has never been in an accident and always serviced by VW.

    Secondly, my car was first bought and registered on December 24 2007 and therefore I assumed warranty was until this Friday (24/12/2010). However, unfortunately it appears the car was "pre-registered" by the original selling dealer the month prior (as an RDA? what does that mean?) and so despite all receipts for original ownership and 1st registration (QLD transport) being dated 24/12/2007 VW claim the warranty to have expired in November when the selling dealer "pre-registered" the vehicle. What are your thoughts? How can I pursue this?

    Any assistance and advice would be much appreciated.

    Hi there,

    I would look in the MKV section for the extended warranty thread. It would pay to look in to that, because I would in your shoes want to keep the car under some warranty if possible.

    As for the dates variance, it may have been a demo, so the purchase date and registration date may not coincide? But a new car warranty should run from the date of purchase of the original owner and stated in the owners manual where all of the cars details are (near the front) - if it was sold as a new and not ex-demostrator model.

    As for the radiator, I've never heard of it, but doesn't mean it hasn't happened.

      The vehicle has to be of merchantable quality and should out last the 3 years warranty period , ring your consumer affairs in QLD straight away and explain that your being fobbed off on warranty repairs, even if the dealer had registered it the month before which i doubt ,but it might of been used as a demo using dealer plates for that month which doesn't count as it was first registered 24/12/07

          Just because you may not get is sorted out, I would make sure you document everything very well as next year you will be well outside warranty etc.

            At no point did the original poster mention that he/she was fobbed off. Also, if the car is out of warranty, it's out of warranty. It's up to the manufacturer to decide whether they will pay or part-pay for any repairs that may be required outside of the warranty period.

            Anyhoo...

            SM86, is there any mention of where the leak in the radiator is? I've seen a few with tanks that have separated from the core. As you've purchased the car as an ex-demo (assumption based on the information you've provided), you may be able to apply for goodwill assistance by VW. However, this will be at the discretion of VW, and you may have to absorb some of the cost yourself.

            VW are reasonably good with cars that are no longer in the warranty period, but there are a few critera that need to be met. For instance, is it out of warranty by time, or distance? Are you the original owner? Does the car have full service history with a VW dealer? If the cards fall your way, you should be ok.

                The dealer has told him its out of warranty,Yet the car was first registered on the 24 DEC 07, so when does the warranty really start, i was under the impression it started from the time it was first registered ,If the owner has proof of that he should pursue a warranty claim.

                  I'd argue that point. The manufacturer can tell you when they think the item is out of warranty, however, the facts remain that new goods are warranted from the date of purchase/invoice - this happens a lot with serialised electronics when the manufacturer think that the date the warranty begins the day they despatch the item from their warehouse.

                  A car is sold as new on the date it is registered, so I am unable to understand how they sold the car before it was registered? I am sure the owner cannot take delivery before registration.

                    The car's warranty period begins on the day it is first registered.

                    In this case, the dealer may have had the car on the books as a demo, hence registering it the month prior. Dealers often do this, and count it as a sale in the previous month to meet a sales target. Whether it was actually driven on the road or not before it found a new home with the original poster is another thing. For we (and the OP) know, they could've slapped the plates and sticker on it the day he/she received the keys to it.

                    I see it as a slight misunderstanding on the basis of a technicality. Regardless, I do believe (based on what I see, and how we deal with these matters at my dealership) that VW will come to the party, and all will be sorted in the most amicable fashion.
