In terms of the way the ADR system works, technically anything that hasn't been ADR approved is 'illegal'. One of the largest costs within the R&D process for new products (in almost any market where liability is a big factor) is design approval. This is why, even from Germany, you can buy non-TUV approved products for significantly less money. As has been said already, it really depends on how much of a muppet the charging officer is! Technically, you can be booked and/or defected for making any changes to a car, as you have altered it from its originally-approved state. The whole thing is a grey area and always will be unless all levels of modification are banned, which will never happen because there'd be uproar from an economic perspective - so we're safe for a while.
The trick is to do things carefully, cleanly, and properly
